Terms and Conditions
These terms and conditions tell you the terms and conditions on which you may access Edinburgh Napier University’s online image library (the “Image Bank”) as a registered user.
Please read these terms and conditions carefully before you access the Image Bank, as these will apply to your use as a registered user of the Image Bank and the images published therein (the “Images”). By accessing the Image Bank, you confirm that you accept these terms and conditions and that you agree to comply with them.
If you do not agree to these terms and conditions, you must not access the Image Bank.
Our Terms of Website Use and our Privacy Policy also apply to your use of the Image Bank. In the event of any conflict in terms these terms and conditions take precedence.
We may revise these terms and conditions at any time by amending this page.
Users of the Image Bank
The Images are intended for use by our employees and authorised agents only.
Your account and password
Your user identification code and password, whether chosen by you or allocated by us, must be treated as confidential and not disclosed to any third party.
We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms and conditions.
If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at photography@napier.ac.uk
Intellectual Property Rights
Edinburgh Napier University is the owner or the licensee of all intellectual property rights in and to the Image Bank and the Images. The Images are protected by copyright laws and treaties around the world. All such rights are reserved and Edinburgh Napier University and/or the licensor have the right to take legal action in cases of intellectual property rights violation.
Use of the Images
You may use the Images for marketing and promoting Edinburgh Napier University only and for no other purpose. You must not modify the paper or digital copies of any of the Images you have printed off or downloaded in any way, and you must not use any of the Images separately from any accompanying text (if applicable).
You may only use the Images responsibly. No Images may be used for, or in connection with, any unlawful or immoral or anti-social purpose, or in a manner which is, or may be, damaging to the name or reputation of Edinburgh Napier University or is, or may be, used in any way to the detriment or misrepresentation of any persons depicted.
Users must acknowledge the photographer and source (Edinburgh Napier University) whenever reproducing an Image, electronically or in printed format.
If you use the Image Bank and/or the Images in any way in breach of these terms and conditions, your right to access the Image Bank and use the Images will cease immediately and you must, at our option, return or destroy any copies of the Images you have made.
Governing law and jurisdiction
These terms and conditions will be governed by the laws of Scotland and you and we both agree that the courts of Scotland will have non-exclusive jurisdiction.
